DHS's Chertoff Is Misleading On Border Laptop Searches

Michael Chertoff is claiming that border laptop searches are only conducted when a border guard has a "suspicion" and places the traveler in "secondary inspection" status. From what I've been able to gain by, you know, reading, the official DHS policies don't mention anything about "suspicion" being needed as probable cause, or that laptop searches happen only in "secondary inspection."

If these two points are true, why is it that they don't appear in the formal policies? And on another note, if I don't post for awhile, I'm guessing it's because DHS has scheduled me for a "secondary inspection."

This is pretty typical. If I can search your suitcase and your car when you cross the border, I should be able to pull all of your electronic devices, take them away, inspect them forensically, and then return them at my leisure. It's not like there's any other way for the bad guys to get data into the country, like via email, ftp, peer-to-peer file sharing, hosted websites, steganography.....
